Terms and conditions
It is hereby stated that these terms and conditions govern sales concluded between, on the one hand, individuals visiting the dmslegendsmodels.com website and, on the other hand, the company DMSLegend's, the operator of said website. This contract applies exclusively to private individuals. The customer declares that they are at least 18 years of age and possess the legal capacity—or hold parental authorization—to use the site. The terms "DMS" or "DMSLegend's," as used hereinafter, refer to the company DMSLegend's in its capacity as the operator of the dmslegendsmodels.com website.
Article 1. Prices
All our prices are quoted in euros, inclusive of all taxes, excluding processing and shipping fees.
dmslegendsmodels.com reserves the right to modify its prices at any time without prior notice. Products are billed based on the rates in effect at the time the order is placed. Despite our best efforts, a pricing error may occasionally occur on our website regarding the items offered. Please be assured, however, that we verify prices during the order validation process. If the corrected price is lower than the price displayed on our site, we will apply the lower price. Conversely, if the corrected price is higher, we will inform you and cancel your order, unless you choose to accept the order at the new price.
Products remain the property of DMSLegend's until full payment of the price has been received.
Article 2. Ordering and Confirmation
Customers may place orders online via the dmslegendsmodels.com website. Orders may also be placed by telephone using the contact details and hours listed in the "Contact" section.
After placing an order, the customer will receive a confirmation email containing the contractual information in French. The order will then be validated by DMSLegend's, after which a second email will be sent to the customer confirming that the order is being processed. Please note that DMSLegend's reserves the right to cancel or refuse any order from a customer with whom there is an ongoing dispute regarding payment for a previous order, or who presents any form of risk (see specifically Article 8 – Fraud Prevention).
The customer acknowledges having read and accepted these General Terms and Conditions of Sale prior to placing their order. Validation of the order by the customer constitutes acceptance of these General Terms and Conditions of Sale. Unless proven otherwise, the data recorded on dmslegendsmodels.com constitutes proof of all transactions made on dmslegendsmodels.com.
In the event of an order cancellation initiated by the customer, the customer may choose between a refund or a credit to their customer account. Please note that DMSLegend's reserves the right to retain any costs incurred (e.g., commissions not refunded by PayPal if the customer requests a refund, order preparation and restocking fees if the order has already been prepared, etc.).
Article 3. Availability and shipping times
Our product offers are valid as long as they appear on the site. We accept orders subject to the stock available at our premises. Information regarding availability is provided on each product page and at the time you place your order.
The stated timeframes are standard averages; they combine the shipping processing time (indicated on the product page) with the transit time.
Errors or changes may occur in exceptional cases. If, despite our best efforts, a product becomes temporarily unavailable, we will notify you by email and/or telephone as soon as possible. As your satisfaction is our priority, we reserve the right to propose alternatives that meet your needs—such as a replacement product of equivalent quality and price. You are then free to accept our proposal or cancel your order. In the event of permanent unavailability where no alternative can be offered, your order will be automatically cancelled.
Payment by check:
If paying by check, your order will only be shipped once DMSLegend's has received and validated your check. Consequently, the shipping and delivery times stated on our website at the time of ordering will not apply. Please note that some checks may take up to approximately 8 business days to be fully validated. This means that, in such cases, your order will only be shipped approximately 8 business days after receipt of your payment.
Ordering multiple products:
When ordering multiple products simultaneously that have different shipping times, the shipping time for the entire order is based on the longest shipping time among them. However, DMSLegend reserves the right to split shipments. Naturally, the contribution towards processing and shipping costs will be charged for a single shipment only.
Article 4. Delivery
Products ordered on dmslegendsmodels.com are delivered to the address you provided during the ordering process. You must verify the completeness and accuracy of the information provided when placing your order, particularly regarding the delivery address.
DMSLegend's cannot be held liable for any inability to deliver the product due to an imprecise or incorrect address. In such a case, any costs incurred for re-shipping the order will be at your expense.
Regarding postal delivery, if the user is not present at the delivery address specified in the order on the day of delivery, a delivery attempt notice will be left in their mailbox. It is the user's responsibility to collect the parcel or tracked letter from the postal service, in accordance with the terms stated on the notice.
If the parcel or tracked letter is not collected by the user from the postal service within the allotted time, or if delivery proves impossible (refusal, imprecise address, etc.), the shipment will be returned to DMSLegend's. In such an event, the user may choose either to cancel the order and receive a refund (excluding shipping and other fees) or to have the product(s) re-shipped at their own expense.
For in-stock orders placed on dmslegendsmodels.com before 8:00 AM, Monday through Friday (excluding public holidays), shipment will take place on the same day or the following day, subject to payment validation (see sections 5 and 8).
Products purchased on dmslegendsmodels.com are delivered to Metropolitan France, Corsica, Monaco, Belgium, and Luxembourg. We also accept delivery to other countries within or outside the EEC.
Orders must be submitted to us via email and will be processed on a case-by-case basis. Please note that orders delivered outside France may be subject to taxes imposed upon the package's arrival at its destination. Any customs duties and taxes associated with the delivery of an item are your responsibility. It is therefore up to you to check with local authorities regarding import regulations or product/service usage; under no circumstances shall we be held liable for non-compliance with the laws of the country where the product is delivered.
DMSLegend's cannot be held liable for consequences resulting from shipping delays.
Package Packaging:
All orders are packed in cartons suitable for transport and handling. Package interiors are protected with air cushions, packing peanuts, or bubble wrap. Packages are sealed with adhesive tape. Shipments are thus well-protected to minimize risk during transport.
Shipping Costs:
You can view shipping costs on each item's product page by clicking the "Add to cart" button. Shipping costs depend on the total weight of the order. Shipping costs are not cumulative; depending on the weight of the items, you may pay the same shipping fee for an order of one, two, or three items.
Shipping Times (Metropolitan France, Europe, and Worldwide):
Delivery times range from 2 days (Metropolitan France) to 15 days (outside Europe). Please allow an additional 3 to 15 business days for items not currently in stock.
Article 5. Payment
France, Monaco, and Andorra:
Purchases may be paid for:
- By bank card: Visa, MasterCard, American Express, or other debit/credit cards.
- By bank check denominated in euros, made payable to DMSLegend's.
If paying by bank check, the check must be issued by a bank based in metropolitan France or Monaco and sent to the following address:

The order will only be confirmed once we have received the check.
Other countries:
Payment is made by bank card.
Payment confirmation:
Payment is processed at the time the order is confirmed. For bank card payments, your account will be debited upon order confirmation; for check payments, the check will be cashed upon receipt.
Naturally, if an order is cancelled due to product unavailability as described in Article 3, we will immediately refund the full amount (the refund will be issued within a maximum of 48 hours following the order cancellation).
Promotional items: Exclusion of certain payment methods
For any order containing at least one promotional item, we generally do not accept payment via American Express (due to the high costs associated with this payment method relative to the margins generated by a promotion). If we receive an order containing promotional items paid for via American Express, the customer will be required to pay an additional fee, the amount of which we will communicate to them. Otherwise, we reserve the right to refuse the order.

Article 6. Satisfaction Guarantee
You have the statutory 14-day period (starting from the date of receipt of the goods) to exercise your right of withdrawal, in which case you will be refunded the full amount paid.
Furthermore, as your satisfaction is our constant goal, we offer an additional 7-day period—as a gesture of goodwill—allowing you to return products that do not suit you. During this additional period, you may return products without providing a reason, and we will refund the full price of the item, excluding shipping costs. You therefore have a total of 21 days from receipt to return a product, provided the conditions set out in Article 7 are met.
If the right of withdrawal is exercised within the aforementioned period, only the amounts mentioned above will be refunded; return shipping costs remain your responsibility.
The right of return does not apply to equipment used by the customer, nor to services where performance has begun—with the customer's agreement—before the end of the aforementioned period (e.g., made-to-order products, as noted on the product pages). Returned products must be new, unused, and returned in their intact original packaging.
Article 7. Return and Refund Procedures
Return conditions:
The item must be returned in perfect condition and in its original, undamaged packaging.
Any item that is damaged, incomplete, or shows clear signs of handling will not be refunded.
Return shipping costs are the customer's responsibility, unless the return is due to a packing error by DMSLegend's or a defective product upon receipt.
Procedure to follow:
Contact us via email at dmslegends@dmsprod.fr or using the contact form, providing your order number and the reason for the return.
Wait for our confirmation before shipping, then send the carefully packed parcel to the address provided to you.
Refund or exchange:
Upon receipt and inspection of the product, we will process either a refund or an exchange, depending on your preference. Refunds are issued to the original payment method used for the order (card, PayPal, etc.).
Product received damaged or packing error:
Did your product arrive damaged, or did we send you an item that does not match your order? Contact us within 48 hours with a photo of the product in question.
DMSLegend's will cover the return shipping costs, or you will receive a full refund, depending on your preference.
Incomplete order:
Contact us via email at dmslegends@dmsprod.fr or using the contact form, providing your order number and a photo of your order as received.
Article 8. Data Security & Fraud Prevention
dmslegendsmodels.com makes every effort to ensure the security of its customers' data. In particular, we have adopted the SSL (Secure Socket Layer) encryption process, which guarantees that credit card details are encrypted and never transmitted in plain text over the network. Payments are processed directly by the bank.
Furthermore, to ensure transaction security and prevent fraud in distance selling, DMSLegend's reserves the right to verify the personal data provided by the customer and to take any measures deemed necessary to confirm that the person whose bank account is being debited is indeed the person who placed the order. Consequently, we may contact you and request that you send us—via email—proof of address, proof of identity, and/or banking documents (e.g., utility bill, telephone bill, ID card, bank account details/RIB, or a voided check). If no response is received within 3 days of the request sent by DMSLegend's, or if the documents provided do not allow us to verify the identity of the person placing the order and the validity of their address, we will be obliged to cancel the order to ensure the security of online transactions.
DMSLegend's also reserves the right to directly cancel any order that presents one or more risk factors indicating potential fraudulent use of a bank card.

Article 10. Intellectual Property
1- All texts, comments, works, illustrations, and images reproduced on dmslegendsmodels.com are protected by copyright and intellectual property laws worldwide. Accordingly, and in compliance with the provisions of the Intellectual Property Code, use is permitted solely for private purposes, subject to any different or more restrictive provisions within the Intellectual Property Code. 2- Certain products, particularly software, are subject to specific personal usage rights governing copying, public distribution, and rental. You must comply with the general terms and conditions of sale for these products, and DMSLegend's shall not be held liable for how the products are used in this context.
Article 11. Liability
The products offered comply with current French legislation and standards applicable in France. DMSLegend's shall not be held liable for non-compliance with the laws of the country where the product is delivered (e.g., in the event of a product ban). It is your responsibility to check with local authorities regarding the import or use of the products or services you intend to order.
Photographs are provided for illustrative purposes only. Please refer to the description of each product for its specific characteristics. Naturally, should you have any doubts or questions regarding the products, please contact DMSLegend's.
DMSLegend's is liable only for the content of the pages it publishes. DMSLegend's shall not be held liable in the event of a manifest discrepancy between the product's characteristics and its representation and/or the terms of sale.
In the case of professional purchases, DMSLegend's shall not be held liable for any indirect damages arising from these terms—such as loss of business, loss of profit, loss of opportunity, damages, or costs—that may result from the purchase of the products. We remind you that it is prudent to back up any data contained in the purchased products. DMSLegend's shall not be liable for any loss of data or files, or for the damages defined in the preceding paragraph. Total or partial inability to use the products—particularly due to hardware incompatibility—shall not give rise to any compensation, refund, or liability claim against DMSLegend's. While our products offer performance levels compatible with professional use, DMSLegend's does not primarily target professional customers. Consequently, DMSLegend's shall not be held liable for any loss or damage whatsoever resulting from professional activity.
Article 12. Warranty
1. Statutory warranty
We undertake, at your option, to refund or exchange products that are visibly defective or do not correspond to your order. If you wish to request a refund via dmslegendsmodels.com, please contact us using the dedicated section. Products must be returned to us in the condition in which you received them, including all components (accessories, packaging, instructions, etc.).
In any event, you benefit from statutory warranties regarding the conformity of the goods to the contract and against hidden defects, in accordance with legal provisions.
The provisions of this article do not prevent you from exercising the right of withdrawal provided for in Article 6.
2. Contractual warranty
Products purchased on dmslegendsmodels.com may be covered by a warranty. To find out the procedure for after-sales service regarding any product issue, you may contact DMSLegend's. To benefit from the product warranty, you must retain the purchase invoice.
Contractual warranties do not cover:
- abnormal or improper use of the products. In this regard, we advise you to carefully consult the user manual provided with the products.
- defects and their consequences resulting from intervention by a third party not authorized by DMSLegend's.
- defects and their consequences resulting from use inconsistent with the product's intended purpose (professional use, collective use, etc.).
- defects and their consequences resulting from any external cause.
However, in any event, you benefit from the provisions of the statutory warranty, particularly those specified in Article 13.1 above.
Article 14. Governing Law - Disputes
This contract is governed by French law. The language of this contract is French. In the event of a dispute, French courts shall have exclusive jurisdiction.

Information and data concerning you are necessary for managing your order and our business relationship. They may be transmitted to companies involved in this relationship, such as those responsible for the execution of services and orders (handling, fulfillment, processing, and payment). This information and data are also retained for security purposes, to comply with legal and regulatory obligations, and to enable us to improve and personalize the services we offer and the information we send you.
In accordance with the Data Protection Act of January 6, 1978, you have the right to access and rectify personal data concerning you. Simply write to us online or by mail, providing your surname, first name, email address, postal address, and, if possible, your customer reference number.
